When filing for workers’ compensation in Minnesota, one of the things you need to be aware of is what to do in the event that your claim is denied. Claims can be rejected for many reasons but an initial denial does not need to be the end. You can pursue options to have your benefits claim reviewed further. When a claim is denied, you should receive a detailed explanation outlining the reasons for the denial. The Minnesota Department of Labor and Industry explains that for most employees in the state, the first step after receiving notice of a denied claim is to contact your case adjuster directly. However, if you work for certain unions, especially those in the construction industry, you should direct your inquiries to your union’s own process. Similarly, if your claim is being handled through a managed care plan, that plan will have its own specific dispute resolution process that must be followed.

If your claim is being handled by an adjuster and that person cannot adequately address your denial concerns, you have additional options. You can pursue help via the Department of Labor and Industry’s Alternative Dispute Resolution team. If that process results in another denial of your claim, you can request mediation of your case.
