Most workers have the right to worker’s compensation if injured on the job. Knowing this can provide significant reassurance. Having the right to compensation does not guarantee that you will get what you need.

Insurers would prefer to limit what they pay out in order to boost their bottom line. That’s why it is so important to avoid making mistakes if you do need to make a claim. Here are some to watch out for.

1. Failing to gather appropriate evidence

The insurer will want proof that you are injured and that the injuries occurred while at work. If they can successfully argue that the accident occurred elsewhere, they may avoid paying out. Taking photos, getting the contact details of witnesses and getting a medical checkup straight away can all help document that the injuries did indeed occur at work.

2. Failing to comply with the reporting requirements

You will need to meet several deadlines when claiming. For example, you need to report the incident to your employer within a certain time, file the claim within a certain time, and if denied, file a challenge within a certain time. Missing a deadline could cost you your chance to claim.

3. Failing to comply with doctor’s orders

The insurer should base their payment on the doctor’s opinion about how much the injury will affect you and for how long. If you don’t follow your doctor’s orders, you could jeopardize your claim. Examples could include working in the garden when the doctor says you should avoid physical exercise or trying to return to work in a month when the doctor says you should be off for three.
